Where applicable under Victorian law, eligible used motor vehicles may be covered by a statutory warranty.
Generally, a statutory warranty applies to a used car that:
Is less than 10 years old; and
Has travelled less than 160,000 kilometres.
The statutory warranty generally lasts for 3 months or 5,000 kilometres, whichever occurs first.
The statutory warranty does not apply to every type of vehicle or transaction. For example, specific exclusions may apply to certain commercial vehicles, motorcycles and vehicles sold at public auction.
Where a statutory warranty applies, it operates in addition to other rights and remedies available under the Australian Consumer Law.
Used vehicles may have characteristics consistent with their age, kilometres travelled, previous use and general condition.
Where required by law, relevant defects and other prescribed information will be disclosed in the applicable vehicle documentation.
Nothing in these Terms is intended to exclude liability for defects, representations or consumer guarantees where such exclusion is prohibited by law.
Where required by Victorian law, the appropriate roadworthy documentation will be provided in connection with the sale of a registered vehicle.
Applicable registration, transfer and other vehicle-related requirements will be handled in accordance with Victorian law and the terms of the relevant sale agreement.
A roadworthy certificate does not necessarily guarantee that a vehicle is mechanically perfect or suitable for every purpose.
Where a cooling-off period applies to a vehicle purchase under Victorian law, the applicable statutory cooling-off rights will apply.
For eligible retail purchases of new or used motor vehicles from a licensed motor car trader in Victoria, buyers generally have 3 clear business days after signing the contract to change their mind, subject to statutory exceptions.
The cooling-off period may not apply in certain circumstances, including particular vehicle types, purchaser categories or where delivery of the vehicle is accepted during the cooling-off period.
Any cooling-off rights, conditions and applicable deductions will be governed by the relevant legislation and the vehicle sale agreement.
The actual purchase of a vehicle is governed by the written vehicle sale agreement entered into between the buyer and Hanneysee Car Sales.
The sale agreement will contain the legally required particulars relating to the vehicle, price, payment arrangements, trade-in arrangements where applicable, warranty information and other relevant terms.
If there is any inconsistency between these website Terms and the signed vehicle sale agreement, the applicable sale agreement and mandatory legal requirements will prevail in relation to the vehicle transaction.
If you choose to purchase a vehicle using finance, any finance arrangement may be subject to separate terms and approval by the relevant lender or credit provider.
Submitting an enquiry or application for finance does not guarantee approval.
Finance terms, interest rates, fees, repayment amounts and other conditions are determined under the applicable finance agreement.
